Marissa Carnevale presented as part of a panel of counsel at the 38th Annual Forum on Franchising of the American Bar Association, held from October 14 to 16, 2015 in New Orleans, LA, U.S.A.
The panel discussed best practices for franchisors and franchisees in advertising on social media, as well as the associated risks. It addressed what is effective and what may be counter-productive, and when advertising may become spam. The laws that govern the use of social media, including recent developments in anti-spam and anti-texting laws in the United States and Canada were explored, as well as franchisors’ implementation of social media policies as they affect advertising.
The paper and PowerPoint containing the legal research, analysis, and examples underpinning this panel presentation were prepared on behalf of our firm by Marissa Carnevale and Bruno Floriani, together with the other panelists, and are available on the ABA Forum Committee on Franchising website.
