Overview

Antonietta Melchiorre, a partner of the firm since 2000, has been practicing with Lapointe Rosenstein Marchand Melançon since her admission to the Bar in 1992.

She is an administrative judge, on a part-time basis, at the Financial Markets Administrative Tribunal (“Tribunal administratif des marchés financiers”).

Antonietta is an Arbitrator and an accredited mediator in civil, commercial and labour law matters.

Since February 2019, on a regular basis, she volunteers at the Palliative Care Unit of Hôpital Marie-Clarac.

She is also a member of the firm’s Ethics Committee and LRMM au féminin.

Prior to her appointment as an administrative judge at the Financial Markets Administrative Tribunal, she led the Securities Litigation Team.

Antonietta represents clients in significant civil and commercial litigation matters. Over the years, she has acquired extensive experience in disciplinary law, ethics and professional liability litigation, real estate litigation, banking litigation, matters pertaining to civil and professional liability, franchising disputes, construction, litigation in insurance law, estate litigation and securities litigation.

In connection with disciplinary law, ethics and professional liability litigation, Antonietta represents various professionals who are the object of a disciplinary investigation or an inspection from its professional orders. She pleads regularly before the disciplinary committees.

Antonietta represents clients in a full range of securities-related matters, including defense of brokerage firms and their representatives before the Courts and administrative tribunals in penal and disciplinary proceedings. More particularly, she represents financial advisors in the context of disciplinary proceedings instituted before the Disciplinary Committee of the Chambre de la sécurité financière and the Investment Industry Regulatory Organization of Canada (IIROC).

Prior to her appointment at the Financial Markets Administrative Tribunal, she regularly represented clients who were under investigations conducted by the Autorité des marchés financiers and witnesses in connection with such investigations. She also represented clients facing civil or penal proceedings instituted by the Autorité des marchés financiers before the Court of Quebec or before the Tribunal administratif des marchés financiers in relation to illegal practises of the profession, the sale of “offshore investments”, non-compliance with public filing obligations, market manipulation, insider trading, and other violations of securities legislation of this nature.

Antonietta has also developed substantial experience with Commissions of Inquiry, having represented several clients in connection with the Commission of Inquiry on the Awarding and Management of Public Contracts in the Construction Industry.
